How to Collect a Small Claims Judgment in Germany

The Short Answer

In Germany, enforce a small claims judgment via compulsory enforcement (Zwangsvollstreckung) through the local Amtsgericht—typically starting with wage or bank account garnishment under §§ 704, 803 ZPO.

What the Law Says

German civil enforcement is governed by the Zivilprozessordnung (ZPO). Small claims—often resolved via the Mahnverfahren (dunning procedure)—become enforceable titles (Vollstreckungstitel) once the debtor fails to object or loses an opposition proceeding. Enforcement then proceeds under Part 8 of the ZPO.

Judgments from the Amtsgericht (district court) — which handles all civil claims up to €5,000 — are immediately enforceable upon becoming final (rechtskräftig), i.e., after expiry of the appeal period (§ 704 ZPO). For uncontested Mahnbescheide, enforceability arises automatically after 14 days if no objection (Widerspruch) is filed (§ 692 ZPO).

Compulsory enforcement requires an enforceable title and a court-issued enforcement order (Vollstreckungsklausel) under § 724 ZPO. The creditor must file an application with the Amtsgericht where the debtor resides or holds assets.

Statutory Text

A judgment becomes an enforceable title when it has become final and contains a clause permitting enforcement.

— Zivilprozessordnung (ZPO), § 704
Statutory Text

The enforcement clause shall be issued by the court that rendered the judgment, upon application and proof of enforceability.

— ZPO, § 724(1)

What to Do

1

Obtain the Vollstreckungsklausel: Submit a written application (Formular 'Antrag auf Erteilung einer Vollstreckungsklausel') to the issuing Amtsgericht, along with the original judgment and proof of finality (e.g., certificate of non-appeal).

2

Identify debtor’s assets: Use public registers (e.g., Schufa for credit data, Grundbuch for real estate) or hire a private debt collector (Inkassobüro) authorized under § 4d UWG. Wage garnishment requires employer details; bank garnishment requires IBAN.

3

Initiate Zwangsvollstreckung: File an enforcement application (Vollstreckungsantrag) with the Amtsgericht’s enforcement division (Gerichtsvollzieheramt). The court-appointed bailiff (Gerichtsvollzieher) will serve writs and seize assets per §§ 803–811 ZPO.
