The Short Answer

No — German law does not require the tour operator to provide a replacement trip. Instead, you may cancel the contract and claim a refund, price reduction, or compensation for damages.

What the Law Says

German law treats package tours (Pauschalreisen) as special contracts with strong consumer protections. If your tour suffers a serious defect, your main remedy is termination — not a replacement trip.

Under BGB § 651l, you may terminate the travel contract only if the defect 'significantly impairs' the package tour — for example, closure of an advertised swimming pool for the entire stay, or failure to provide booked accommodation or transport.

Termination is only allowed after giving the tour operator a reasonable deadline to fix the problem — and they fail to do so. You must formally notify them in writing.

If you cancel, the operator must refund all payments for services not yet provided. They keep payment only for services already delivered — unless those were defective too.

Crucially, the law requires the operator to arrange your return transport immediately — using a vehicle or flight equivalent to what was promised. Any extra costs fall on them.
