What the Law Says

German traffic law strictly limits mobile phone use while driving to prevent distraction and ensure road safety. The core rule is a near-total ban on physical interaction with electronic devices during vehicle operation.

Under StVO § 23(1a), drivers are prohibited from holding or manually operating any electronic device used for communication, information, or organization—including smartphones, tablets, navigation devices, and entertainment systems.

Permissible use is extremely narrow: the device must remain untouched, and operation must rely solely on voice control and text-to-speech — or involve only a brief, situation-appropriate glance away from traffic (e.g., tapping a mounted navigation screen for <1 second while stopped at a red light).

Wearing visual display devices like video glasses (e.g., AR/VR headsets) is completely forbidden while driving. Sights projected onto windshields (e.g., HUDs) are allowed only for vehicle- or traffic-related information — not for calls, messages, or videos.

The ban applies only when the vehicle is *in motion* or *ready to move*. A vehicle is considered 'not moving' only if it is legally parked *and* the engine is fully switched off — idling, stop-and-go traffic, or engine auto-stop (e.g., start-stop systems) does *not* qualify.

Wer ein Fahrzeug führt, darf ein elektronisches Gerät, das der Kommunikation, Information oder Organisation dient oder zu dienen bestimmt ist, nur benutzen, wenn hierfür das Gerät weder aufgenommen noch gehalten wird und entweder nur eine Sprachsteuerung und Vorlesefunktion genutzt wird oder zur Bedienung und Nutzung des Gerätes nur eine kurze, den Straßen-, Verkehrs-, Sicht- und Wetterverhältnissen angepasste Blickzuwendung zum Gerät bei gleichzeitig entsprechender Blickabwendung vom Verkehrsgeschehen erfolgt oder erforderlich ist.
