What the Law Says

The Military Rehabilitation and Compensation Act 2004 (MRCA) is the exclusive compensation scheme for injuries sustained by members of the Australian Defence Force (ADF) — including during vehicle accidents on military bases — while rendering defence service.

The MRCA replaces all state-based workers’ compensation and motor accident (CTP) schemes for ADF members injured in the course of their service. This includes accidents occurring on Defence property such as military bases, regardless of whether the vehicle was military or private.

To be eligible, the injury must have occurred 'in the course of rendering defence service' — a broad definition that covers duty-related travel, training, and even some off-duty activities if connected to service obligations.

The MRCA operates on a no-fault basis: you do not need to prove negligence to receive compensation, but you must meet statutory definitions of 'member', 'defence service', and 'injury'.
