What the Law Says

Australian workers’ compensation law allows for further claims when an existing work injury deteriorates or is aggravated — but strict timeframes and procedural requirements apply.

If your work-related injury worsens — for example, due to medical deterioration, new complications, or aggravation from ongoing duties — you may be entitled to additional compensation. This includes increased weekly payments, further medical expenses, or lump sum payments for permanent impairment.

The key requirement is that the worsening must be connected to the original work injury and reported promptly. Under the Workers Compensation Act 1987 (NSW), you must notify your employer of any change in condition 'as soon as practicable', and generally within 7 days of becoming aware of the deterioration.

You must also lodge a claim for aggravation or further injury with the insurer within 12 months of the date the worsening became apparent — unless exceptional circumstances apply.
