What the Law Says
In Germany, your rights for defective products don’t vanish when the seller’s voluntary warranty ends. The law provides separate, mandatory time limits — called 'Verjährung' — during which you can legally enforce claims for defects.
Under § 438 of the German Civil Code (BGB), the statutory limitation period for claims arising from defects (e.g., repair, replacement, price reduction, or rescission) depends on the type of product. For most consumer goods, the limitation period is two years from delivery.
Longer periods apply in special cases: five years for buildings and items used in construction that cause structural defects, and up to 30 years for defects linked to third-party property rights registered in the land register.
Importantly, this limitation period starts with delivery — not with the end of any commercial warranty. So even if the seller offered only a 1-year warranty, your legal rights may still be active for up to two years after you received the item.
If the seller knowingly concealed a defect (arglistige Verschweigung), the standard 30-year limitation applies — but the shorter minimum periods (e.g., 5 years for buildings) still act as floors: the claim won’t expire before those times elapse.
