What the Law Says
The telecommunication secrecy obligation in Germany stems from the Telecommunications Act (TKG) and protects the confidentiality of all telecommunications — including phone calls, emails, and messaging — while permitting narrowly defined exceptions for state surveillance.
Under TKG § 170, operators of publicly accessible telecommunications networks must implement technical and organizational measures to ensure lawful surveillance can be carried out — but only when explicitly ordered by authorized authorities and strictly limited by law.
This obligation does not mean surveillance happens routinely. Instead, it requires providers to be technically prepared so that, if a valid judicial or administrative order is issued (e.g., under the Article 10-Gesetz or BND-Gesetz), they can execute it immediately and completely.
Providers must also appoint a domestic representative for service of surveillance orders, notify the Federal Network Agency (Bundesnetzagentur) upon launch, and submit documentation proving compliance — all at their own expense.
