What the Law Says

BGB § 616 — 'Temporary prevention of performance' — ensures that an employee does not lose their right to remuneration if they are prevented from working for a 'proportionally not significant time' due to personal reasons beyond their control, such as sudden illness.

This provision applies only when the absence is brief and unforeseeable — courts typically interpret 'proportionally not significant' as up to about five working days, depending on employment duration and context.

Importantly, any sickness benefit received from statutory health insurance (gesetzliche Krankenversicherung) must be deducted from the employer’s wage continuation payment — meaning you don’t get double pay for the same period.

Der zur Dienstleistung Verpflichtete wird des Anspruchs auf die Vergütung nicht dadurch verlustig, dass er für eine verhältnismäßig nicht erhebliche Zeit durch einen in seiner Person liegenden Grund ohne sein Verschulden an der Dienstleistung verhindert wird. Er muss sich jedoch den Betrag anrechnen lassen, welcher ihm für die Zeit der Verhinderung aus einer auf Grund gesetzlicher Verpflichtung bestehenden Kranken- oder Unfallversicherung zukommt.
