The Short Answer

In Germany, boundary disputes often hinge on whether an encroachment (Überbau) occurred unintentionally — if so, the neighbor usually must tolerate it but is entitled to annual ground rent under BGB § 912. Immediate objection is critical to preserve removal rights.

What the Law Says

German property law balances ownership rights with fairness in boundary conflicts. Two key provisions govern most disputes: one affirms your right to exclude others from your land, and another limits that right when a neighbor unknowingly builds across the line.

Under BGB § 903, you have full control over your land — you may use it freely and exclude others — unless a law or third-party right says otherwise. This is the foundation of your property claim.

But BGB § 912 creates an important exception for unintentional encroachments (Überbau). If your neighbor built part of a structure over your boundary without intent or gross negligence, you generally must tolerate it — *unless* you objected before construction finished or immediately after discovering the overstep.

Even if you must tolerate the encroachment, you’re entitled to fair compensation: an annual ground rent (Überbaurente), calculated based on the time the building has overlapped your land.

Statutory Text

BGB § 903 — German Civil Code
Statutory Text

What Courts Have Said

German courts consistently apply BGB § 912 to balance fairness and legal certainty — especially when removal would cause disproportionate hardship.

BGH V ZR 124/25
Bundesgerichtshof, 5. Zivilsenat · 2026

The court upheld the neighbor’s right to demand removal only where timely objection was made; otherwise, tolerance and rent were required, weighing structural permanence and hardship.

BGH V ZR 28/20
Bundesgerichtshof, 5. Zivilsenat · 2021

Confirmed that unintentional encroachment triggers mandatory tolerance under § 912 BGB, and the affected owner is entitled to an annual ground rent — not lump-sum damages.

What to Do

1

Confirm the exact boundary using an official land survey (Katasteramt or licensed surveyor).

2

If an encroachment is confirmed, object in writing *immediately* — before construction finishes or within days of discovery.

3

If you missed the objection window, request a fair annual ground rent (Überbaurente) — negotiate or seek mediation.

4

If negotiation fails, file a civil claim at the local Amtsgericht for either removal (if timely objection) or rent determination.
