The Short Answer

Yes, there is no statutory upper cap on motor accident compensation in India, but the Motor Vehicles Act, 1988 (as amended in 2019) prescribes minimum compensation amounts and allows courts to award just and fair compensation based on evidence.

What the Law Says

The Motor Vehicles Act, 1988 — as amended by the Motor Vehicles (Amendment) Act, 2019 — governs compensation for motor accident victims in India. While it sets mandatory minimum compensation, it does not impose a maximum cap. Instead, it empowers tribunals and courts to award 'just and fair' compensation after considering factors like age, income, dependency, and severity of injury or loss.

Section 163A of the Motor Vehicles Act, 1988 provides for compensation on a no-fault basis in cases of death or permanent disablement. It mandates minimum amounts: ₹50,000 for death and ₹25,000 for grievous injury — but explicitly permits higher awards if justified.

Section 166 allows claims for compensation before the Motor Accident Claims Tribunal (MACT) on fault-based grounds. Here, compensation is determined using judicial precedents (e.g., the multiplier method), medical evidence, and income proof — with no upper statutory limit.

The 2019 Amendment introduced stricter timelines: claims must be filed within 30 days of the accident (though condonation is possible), and tribunals are directed to dispose of cases within 120 days from filing.
