What the Law Says

The Indian Constitution and various state laws strictly regulate the transfer of tribal land to prevent alienation from Scheduled Tribes. These protections operate through constitutional provisions and state-level legislation.

The Fifth Schedule of the Indian Constitution applies to tribal areas in states other than Assam, Meghalaya, Tripura, and Mizoram. It empowers the Governor to prohibit or restrict the transfer of tribal land to non-tribals.

The Sixth Schedule applies to tribal areas in Assam, Meghalaya, Tripura, and Mizoram, granting autonomous district councils the power to regulate land ownership and transfer — including banning sales to non-tribals.

Many states have enacted specific laws — such as the Andhra Pradesh Scheduled Areas Land Transfer Regulation, 1959; the Chhattisgarh Land Transfer Act, 1956; and the Maharashtra Restoration of Lands to Scheduled Tribes Act, 1974 — that declare transfers of tribal land to non-tribals void unless approved by the competent authority.

Violations often attract criminal penalties: for example, under the Andhra Pradesh Regulation, unauthorized transfers are punishable with imprisonment up to three years and/or fine.
