What the Law Says

The Indian Constitution and the Passports Act affirm that citizenship confers an unqualified right to enter India.

Article 9 of the Constitution of India states that no person shall be a citizen of India if they have voluntarily acquired citizenship of another country. This reinforces that Indian citizenship is exclusive and carries inherent rights — including the right to return.

Article 21 guarantees the 'right to life and personal liberty', which the Supreme Court has interpreted to include the right to reside and settle in India — and by extension, the right to re-enter after travel abroad.

Section 5(2)(a) of the Passports Act, 1967 explicitly provides that 'the passport authority shall issue a passport or travel document to every applicant who is a citizen of India' — affirming that citizenship itself is the sole eligibility criterion for documentation enabling return.
