What the Law Says

The Motor Vehicles Act, 1988 prohibits minors from driving motor vehicles in India. The law sets strict age limits and penalties for violations.

According to the Motor Vehicles Act, 1988, no person under the age of 18 years may drive a motor vehicle on any public road in India. This applies to cars, motorcycles, and most two-wheelers.

However, there is one limited exception: a person aged 16 years or older may drive a motor cycle with an engine capacity not exceeding 50 cc and without gear — but only if they hold a valid learner’s licence issued under the Act.

Driving without a valid licence — including when underage — is a punishable offence. The law treats it seriously, with fines and possible jail time.
