What the Law Says

The Personal Injuries Assessment Board Act 2003 sets out the statutory timeframe for PIAB assessments. Section 49 is the key provision governing how long the process should take.

Under the law, PIAB must issue its assessment within 9 months of receiving a complete application — meaning all required documents, medical reports, and consent forms have been submitted.

However, PIAB may extend this period by up to a further 3 months (making a total of 12 months) if it considers the case unusually complex or if additional information is needed and not provided within a reasonable time.

If PIAB fails to issue an assessment within the statutory timeframe (and no valid extension applies), the applicant may withdraw the claim from PIAB and pursue court proceedings instead.
