What the Law Says

Japanese law allows individuals to formally request reconsideration of a disability grade determination if they believe it is incorrect or incomplete.

Under the Health Insurance Act, a person who disagrees with a disability grade assigned by the Japan Pension Service may file a request for re-evaluation. This must be done within 60 days of the date the decision was notified to the applicant.

The re-evaluation is conducted by a different panel of physicians and specialists than the original assessment team. No fee is charged for this process.

The Japan Pension Service must issue its decision on the re-evaluation within 60 days of receiving the request.
