Under the Torrens system, the government guarantees the accuracy of the land register. Once a person is registered as owner of land, their title is protected by law — even if there was a prior defect or error in the chain of title.
This system replaces the older deed-based system, where ownership depended on proving a valid chain of conveyances. In contrast, under Torrens, registration itself creates and confirms title.
The register is said to be 'indefeasible', meaning it cannot be challenged except in very narrow statutory exceptions (e.g., fraud, misrepresentation, or certain overriding interests).
