The Short Answer

In South Korea, you can report your work injury directly to the Korea Workers' Compensation and Welfare Service (KCOMWELFARE) even if your employer refuses. You have up to 3 years from the injury date to file a claim.

What the Law Says

South Korean law requires employers to report work injuries promptly and gives injured workers the right to file claims independently when employers fail to act.

Under the Industrial Accident Compensation Insurance Act, employers must report a work-related injury or illness to KCOMWELFARE within 15 days of becoming aware of it. If they fail to do so, the injured worker may submit the claim directly.

The law guarantees full coverage of medical expenses, disability benefits, and wage replacement — regardless of employer cooperation — as long as the claim is filed within the statutory deadline.

You do not need your employer’s signature or consent to file. KCOMWELFARE will investigate the facts independently, including reviewing medical records and workplace evidence.

An employer shall report to the competent authority the occurrence of an industrial accident without delay, and in any case, within fifteen days from the date on which the employer becomes aware of such occurrence.
