What the Law Says
South Korean law regulates grave sites through the Funeral Services Act and its Enforcement Decree. The right to use a grave site is administrative and temporary — not ownership of land — and subject to strict public health, land-use, and cemetery management rules.
Under the Funeral Services Act, a person may obtain the right to use a grave site in a public or licensed private cemetery for a fixed term. This right does not confer land ownership or perpetual use.
The initial grant period is generally 15 years for general graves and up to 20 years for certain designated areas, as stipulated in the Enforcement Decree. After expiration, the right may be renewed for additional 5-year terms if the site remains compliant and fees are paid.
If the right is not renewed, or if the grave is abandoned or violates cemetery rules (e.g., unauthorized structures), the cemetery operator may remove remains after providing at least 30 days’ written notice — unless prohibited by family consent or court order.
Fees for grave site use are capped: the maximum burial service fee (including grave site usage) is KRW 5 million for standard services, per Article 24 of the Funeral Services Act.

What to Do
Confirm the expiration date of your current grave site usage right with the cemetery operator or local government office.
Apply for renewal at least 60 days before expiry and pay the required fee (capped at KRW 5 million total for burial services).
Maintain the grave site in compliance with cemetery rules (e.g., no illegal structures, regular upkeep).
