US-CaliforniaCan I get a restricted license after a DUI in California?
Yes, you may be eligible for a restricted license after a DUI in California if you meet specific requirements, including enrolling in a DUI program, filing proof of insurance (SR-22), and paying reissue fees.
What the Law Says
California law allows certain first-time DUI offenders to obtain a restricted driver’s license after serving a mandatory minimum suspension period, provided they comply with statutory conditions.
After a first-offense DUI conviction or administrative per se (APS) suspension by the DMV, your license is typically suspended for 4 months. However, you may be eligible for a restricted license after serving 30 days of that suspension — but only if you meet all statutory requirements.
To qualify, you must enroll in and provide proof of enrollment in a state-approved DUI program (typically 3-month or 9-month, depending on BAC and circumstances), file an SR-22 certificate of financial responsibility with the DMV, pay the $125 license reissue fee, and install an ignition interlock device (IID) if ordered (e.g., in some county pilot programs or for higher BAC).
The restriction generally permits driving only to and from work, to and from the DUI program, and for employment-related purposes — unless an IID is installed, which may expand driving privileges under AB 978 and subsequent expansions.
Statutory TextThe department shall issue a restricted license to a person whose privilege to operate a motor vehicle has been suspended under Section 13352 or 13352.1, if the person has served 30 days of the suspension period and meets all of the following requirements: (a) Enrolls in, and provides proof of enrollment in, a program approved by the court or the department.
