What the Law Says
New York has not enacted a comprehensive consumer privacy law. Proposed legislation — the New York Privacy Act — would establish broad rights and obligations similar to the CCPA and GDPR, but it remains pending and has never been signed into law.
The most prominent proposal is the New York Privacy Act (S.6072/A.5434), first introduced in 2019 and reintroduced in each legislative session through 2024. It would grant consumers rights to access, correct, delete, and opt out of the sale of their personal data, and impose data minimization, purpose limitation, and accountability requirements on businesses.
Unlike sectoral laws like the SHIELD Act (which focuses on data breach notification and reasonable safeguards), the NY Privacy Act is designed to be omnibus — covering collection, use, sharing, and protection of personal data across sectors.
However, no version of the NY Privacy Act has advanced beyond committee referral in either chamber. As of June 2024, it has not been voted on by the full Senate or Assembly.
