What the Law Says

New York public transportation providers must meet both federal and state accessibility mandates. The primary requirements stem from the federal Americans with Disabilities Act (ADA), incorporated into New York law through the State Human Rights Law and specific transit statutes.

Under federal law, all public transportation services operating in New York—including subways, buses, commuter rail, and paratransit—must comply with ADA Title II and implementing regulations (49 C.F.R. Part 37). These require vehicles and facilities to be readily accessible to and usable by individuals with disabilities.

New York State Human Rights Law § 296(2)(a) makes it an unlawful discriminatory practice for any place of public accommodation—including transportation services—to exclude, segregate, or otherwise discriminate against individuals with disabilities. It explicitly incorporates ADA standards by reference.

The MTA’s own accessibility obligations are reinforced by Public Authorities Law § 1271-a, which directs the Metropolitan Transportation Authority to ensure 'full and equal access' for persons with disabilities across all its services, facilities, and communications.
