What the Law Says

German consumer law gives buyers a statutory right to withdraw from most online purchases — including digital content — but with important exceptions that apply specifically to downloads, streams, and other non-physical digital goods.

Under BGB § 356, consumers generally have a 14-day withdrawal period for distance contracts (e.g., online purchases). However, for digital content not supplied on a physical medium — like music, e-books, software, or streaming access — the withdrawal right ends as soon as the supplier begins performance, *if* you gave prior, informed, written consent.

This means: if you clicked 'I agree' to immediate delivery and acknowledged that your right to withdraw would expire upon start of download or streaming, then you lose the right the moment the file begins transferring or the stream starts playing.

Crucially, the withdrawal period does *not* begin at contract conclusion for digital content — it only starts once the seller has provided all required pre-contract information (e.g., price, identity, withdrawal instructions) on a durable medium (like email or webpage). If they fail to do so, your deadline extends up to 12 months and 14 days after the contract was signed.

bei einem Vertrag, der den Verbraucher zur Zahlung eines Preises verpflichtet, wenn der Unternehmer mit der Vertragserfüllung begonnen hat, der Verbraucher ausdrücklich zugestimmt hat, dass der Unternehmer mit der Vertragserfüllung vor Ablauf der Widerrufsfrist beginnt, der Verbraucher seine Kenntnis davon bestätigt hat, dass durch seine Zustimmung nach Buchstabe b mit Beginn der Vertragserfüllung sein Widerrufsrecht erlischt, und der Unternehmer dem Verbraucher eine Bestätigung gemäß § 312f zur Verfügung gestellt hat.
