Graduated rent — known in German law as 'Staffelmiete' — is a type of rent agreement where the landlord and tenant agree in advance on specific rent amounts for defined future periods. It is not an automatic or inflation-linked adjustment, but a fixed, stepped schedule set out in writing at the start of the tenancy or later by mutual agreement.

Under German law, graduated rent is permitted only if agreed in writing and strictly complies with the requirements of BGB § 557a. The parties must specify each rent amount (or exact increase in euros) for each period — vague or formula-based promises (e.g., 'rent rises by 3% every two years') are invalid unless they meet the precise wording and transparency rules.

Each rent level must remain unchanged for at least one full year. During the entire term of the graduated rent agreement, the landlord cannot use the standard statutory rent increase procedures (under §§ 558–559b) — meaning no additional increases based on local comparable rents or hardship claims.

The tenant’s right to terminate the lease early (ordinary termination) may be contractually excluded — but only for a maximum of four years from when the Staffelmiete agreement takes effect. Any longer exclusion is void. Also, any clause that unfairly disadvantages the tenant — such as waiving legal remedies or shifting unreasonable costs — is automatically invalid under § 557a(5).

Finally, certain consumer protections apply: the rules on notice periods, written form, and information duties (found in §§ 556d–556g) apply to each step of the graduated rent, ensuring transparency and fairness.
