What the Law Says
The Housing and Development Act governs who may occupy and rent out HDB flats, including restrictions on subletting rooms. Section 56 sets out key prohibitions and conditions.
HDB flat owners must first fulfil the Minimum Occupation Period (MOP) of 5 years before renting out any part of their flat — unless granted special approval. During MOP, only renting out the entire flat is allowed in very limited circumstances (e.g., owner emigration), not individual rooms.
Owners must also be Singapore Citizens or Permanent Residents, and all tenants must be lawfully in Singapore. Unrelated tenants are capped at three per flat, and the total lease term for rented rooms cannot exceed 10 years.
Failure to obtain prior approval from HDB before renting out a room is an offence. HDB may impose fines, demand vacant possession, or even compulsorily acquire the flat in serious cases.
