What the Law Says

The Housing and Development Act governs who can own or inherit an HDB flat. While a will can transfer ownership, HDB’s regulatory control means the beneficiary must qualify under statutory rules — not just testamentary freedom.

Under Singapore law, you may name your child as a beneficiary of your HDB flat in your will. However, this does not automatically entitle them to keep the flat. The Housing and Development Act gives HDB authority to regulate flat ownership, including after death.

The key restriction is that the inheriting child must meet all prevailing HDB eligibility conditions — such as being a Singapore Citizen or Permanent Resident (with restrictions), at least 21 years old, fulfilling the Minimum Occupation Period (MOP), and not owning another residential property.

If the child does not meet these conditions, HDB may require the flat to be sold — even if it was validly bequeathed under the will.
