South KoreaWhat is MyData?
MyData is a South Korean data governance framework that gives individuals legal rights to access, control, and share their personal data with trusted third parties.
What the Law Says
The MyData system in South Korea is established under the 'Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.' (commonly called the MyData Act), which was amended in 2020 to introduce a formal legal basis for individual data control.
MyData empowers individuals to request their personal data from public and private data holders (e.g., banks, telecoms, health insurers) and authorize its secure transfer to certified MyData service providers.
Only entities certified by the Korea Internet & Security Agency (KISA) may operate as MyData providers. Certification requires compliance with strict security, privacy, and interoperability standards.
Data holders must respond to MyData requests without unjustifiable delay — typically within prescribed timeframes set by subordinate regulations — and must not refuse unless legally exempted.
Statutory TextThe State shall promote the establishment and operation of a personal data management system that enables an individual to manage his/her personal data in an integrated manner.
