If your holiday accommodation in Ireland was not as described, the Package Holidays and Travel Trade Act 1995 gives you the right to compensation or a price reduction from the travel agent or tour operator.

What the Law Says

The Package Holidays and Travel Trade Act 1995 protects consumers who book package holidays in Ireland. Section 20 specifically deals with situations where services — including accommodation — are not provided as described.

Under this law, if you booked a package holiday (which includes transport and accommodation arranged together by a travel agent or tour operator), the provider must deliver all services exactly as described in the brochure, website, or other promotional material.

If the accommodation you received was significantly different — for example, wrong location, missing facilities, lower star rating, or poor condition — this is a breach of contract under the Act.

You are entitled to either a full or partial refund, a price reduction, or compensation — depending on the seriousness of the failure and whether it affected your holiday experience.

Statutory Text

Where a package holiday is not provided in accordance with the contract, the consumer shall be entitled to such remedy as may be appropriate having regard to the nature and extent of the failure, including a reduction in the price of the package holiday or compensation.

Contact the travel agent or tour operator immediately — preferably in writing — describing how the accommodation differed from what was promised.

Keep evidence: photos, booking confirmation, brochure screenshots, emails, and receipts.

Request a price reduction or refund in line with section 20 of the 1995 Act.

You generally have up to 3 months from the end of your holiday to make a formal claim under the Act.
